1. INTRODUCTION
This Privacy Policy applies to the website of Inter.link GmbH (hereinafter referred to as “Inter.link”, “we” or “us”). Other privacy policies may apply to other services and third-party websites. Inter.link takes protecting the privacy of personal data very seriously. As a result, we would like to provide the users of our website information about what data we collect and how this data is used. Applicable privacy law obligates us to process user data in a lawful manner and only for the intended purpose. We will not use this data for anything other than the stated purposes.

5. PURPOSE OF THE PROCESSING & LEGAL BASIS FOR THE PROCESSING
We may process your personal data based on your consent. This includes signing up to our newsletter to get contacted for marketing purposes as well as collecting heatmaps and screen recordings of the website usage. The legal basis for the processing of your personal data is Article 6 (1) (a) GDPR.
The processing of your personal data may be necessary for the performance of a contract between you (or your employer) and us or in order to enter into a contract between you (or your employer) and us on your (or your employer’s) request. This includes ordering products of us through the customer portal and billing you for ordered products. The legal basis for the processing of your personal data in cases where you enter directly into a contract between you and us is Article 6 (1) (b) GDPR. In cases where your employer enters into a contract between them and us the legal basis for the processing of your personal data is Article 6 (1) (f) GDPR.
Once a contract between you (or your employer) and us has been closed, the processing of your personal data is necessary for compliance with legal obligations to which we are subject. This includes legal obligations to keep records about our business transactions for up to 10 years in accordance with § 147 (3) AO and § 257 (4) HGB. The legal basis for the processing of your personal data is Article 6 (1) (c) GDPR.
In some cases the processing of your personal data is necessary for the purposes of our legitimate interests. Our legitimate interest is to provide a functioning website to our customers and interested parties. For this we store information about usage statistics of the website. The legal basis for the processing of your personal data is Article 6 (1) (f) GDPR.
6. Recipients of Personal Data
For the website we use hosting services provided by Raidboxes GmbH, Hafenstraße 32, 48153 Münster, Germany. We use their services to operate the website. We signed a Data Processing Agreement with them. Furthermore, we use European data centers of them to prevent transfers of your personal data to third countries.
For the website we also use usage statistics services provided by InnoCraft Ltd, 7 Waterloo Quay, PO Box 625, 6140 Wellington, New Zealand. We use their Matomo service (formerly known as Piwik) to collect usage statistics, heatmaps and screen recordings of the website in order to provide a functioning website to our customers and interested parties. We signed a Data Processing Agreement with them and have enabled IP anonymization. Furthermore, we use European data centers of them to prevent transfers of your personal data to third countries.
For the newsletter we use the e-mail delivery service provided by The Rocket Science Group LLC d/b/a Mailchimp, 675 Ponce De Leon Avenue, Northeast Suite 5000 Atlanta, GA 30308, USA. We use their e-mail delivery service to send our newsletter to a large amount of recipients while following infrastructure and security best-practices for the delivery of e-mails. We signed a Data Processing Agreement with them. Furthermore, we limited the amount of data transferred to the sub-processor to an absolute minimum. Only your e-mail address is transferred which is required to deliver e-mails to you.
7. Transfer of Personal Data to Third Countries
We implemented additional measures to prevent the transfer of personal data to third countries in cases where we use services of providers that are located outside the European Union. These include the selection of European data centers where available and the implementation of technical measures where necessary.
For the newsletter we transfer your e-mail address to a Third Country. We signed a Data Processing Agreement based on the EU Standard Contractual Clauses to cover the transfer to Third Countries in accordance with Article 46 (2) (c) GDPR. The sub-processor has also entered the EU-U.S. Data Privacy Framework Program to cover the transfer to Third Countries in accordance with Article 45 GDPR.
8. Storage Limitation
Personal data that are processed based on your consent are stored until you have withdrawn your previously given consent.
Personal data that are necessary for the performance of a contract between you (or your employer) and us or in order to enter into a contract between you (or your employer) and us on your (or your employer’s) request are stored at least until the contract is terminated or your (or your employer’s) request to enter into a contract between you (or your employer) and us has been handled.
Personal data that are necessary for compliance with legal obligations to which we are subject are stored at least until the legal obligations have been fulfilled.
Personal data that are necessary for the purposes of our legitimate interests are stored at least until our legitimate interests have been satisfied.
9. Cookies & Local Storage
9.1 Functional Cookies
We store cookies and/or local storage values on your device that are strictly necessary to operate or deliver the website that you requested from us and, thus, do not require you to consent in accordance with § 25 (2) (2) TDDDG. The following cookies and/or local storage values will be stored on your device.
Matomo:
- _pk_testcookie – This cookie is used to check whether the visitor’s browser supports cookies. It expires instantly.
- matomo_ignore, mtm_consent, mtm_consent_removed – These cookies are used to remember that the visitor has opted-out of the Matomo usage statistics. They expire in 30 years. Please take note that some browsers restrict the maximum expiry date of cookies so that they could expire earlier.
- matomo_sessid – This cookie is used to provide the opt-out feature and contains a so-called nonce to prevent CSRF security issues. It is important to note that it does not contain any data used to identify visitors. It expires in 14 days.
- mtm_cookie_consent – This cookie is set to remember that you have opted-in to the Matomo analytics cookies. It expires in 30 years. Please take note that some browsers restrict the maximum expiry date of cookies so that they could expire earlier.
